Who we are

Dr Matcha Studio Limited and Dr Matcha Studio (collectively, "Dr Matcha Studio," "we," "us," or "our") own and operate WorkMetric. Dr Matcha Studio was founded by Mengjie Fan.

Scope and acceptance

These Terms of Use govern access to and use of the WorkMetric application, its content, and any related updates or communications (collectively, the "App"). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.

Eligibility and authority

You must be at least 18 years old to use the App. If you use the App on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms of Use.

License

We grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App for personal or internal business evaluation. This license does not grant any ownership rights in the App or its content.

Health and fitness disclaimer

WorkMetric provides informational training calculations and progress visuals only. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition.

You are responsible for your training decisions and for consulting qualified professionals as needed. Do not rely on the App as a substitute for medical advice or professional coaching.

Accuracy and completeness

Calculations are based on the data you provide. Outputs may be incomplete or inaccurate if inputs are missing or incorrect. You are responsible for verifying any results before acting on them.

Restrictions

• Do not copy, reproduce, distribute, publicly display, or exploit the App or its content without written permission.
• Do not reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, or models.
• Do not remove or alter proprietary notices or attribution.
• Do not use the App to build, benchmark, or train machine learning or AI models.
• Do not use the App to provide unauthorized medical or coaching services.
• Do not circumvent security, access controls, or usage limits.

Intellectual property and design rights

The App, including its UI, design systems, formulas, and data visualization workflows, is owned by Dr Matcha Studio or its licensors and is protected by intellectual property laws. No rights or licenses are granted except as expressly stated in these Terms of Use. All rights are reserved, including rights in derivatives, adaptations, or improvements.

Feedback and submissions

If you submit ideas, feedback, or suggestions, you grant Dr Matcha Studio a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and commercialize them without restriction or obligation.

Privacy

Use of the App is subject to the WorkMetric Privacy Policy, which describes how information is handled and stored.

Third-party services and platform terms

Your use of the App may also be subject to Apple App Store terms and any third-party services you choose to integrate. If those terms conflict with these Terms of Use, the third-party terms may govern their services.

Updates and availability

We may modify, suspend, or discontinue any part of the App at any time without notice. We do not guarantee that the App will be available, secure, or error-free.

Disclaimers

The App is provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of the App is at your sole risk.

Limitation of liability

To the maximum extent permitted by law, Dr Matcha Studio will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the App. In no event will our aggregate liability exceed $100 or the amount you paid to access the App, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Dr Matcha Studio and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the App or violation of these Terms of Use.

Termination

We may terminate or suspend your access to the App if you violate these Terms of Use. You may stop using the App at any time by uninstalling it.

Governing law and venue

These Terms of Use are governed by the laws of the jurisdiction in which Dr Matcha Studio Limited is incorporated, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of courts located in that jurisdiction.

Changes to these terms

We may update these Terms of Use at any time by posting a revised version. Your continued use of the App after changes become effective constitutes acceptance of the updated terms.
