Who we are

Dr Matcha Studio Limited and Dr Matcha Studio (collectively, "Dr Matcha Studio," "we," "us," or "our") own and operate StomaVision, a LumaNorm Studio division demo. Dr Matcha Studio was founded by Mengjie Fan and is currently 100% owned by Mengjie Fan, unless and until ownership changes in the future.

Scope and acceptance

These Terms of Use apply to the StomaVision app, its content, software, updates, documentation, and any related communications (collectively, the "App"). By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.

Eligibility and authority

You must be at least 18 years old to use the App. If you use the App on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms of Use.

License and permitted use

We grant you a limited, revocable, non-exclusive, non-transferable license to install and use the App for internal research, education, professional analysis, or evaluation purposes. This license does not grant any ownership rights in the App or its content.

Professional use and compliance

You are responsible for ensuring your use of the App complies with applicable laws, institutional policies, and data handling requirements. You must maintain any required consents, approvals, or ethics reviews for the images you process.

Your data rights

You represent that you own or have lawful rights and consents to use the images and data you process with the App, including any personal data. You are responsible for complying with research ethics, data protection, and disclosure obligations.

Not for medical diagnosis

Unless explicitly stated in writing by Dr Matcha Studio, the App is not intended for clinical diagnosis, treatment decisions, or regulated medical device use. You are solely responsible for any regulated or clinical use.

Preview and experimental features

The App may include preview, research, or experimental features. These features may change, be incomplete, or be removed without notice. You acknowledge that preview software may contain errors and is provided for evaluation without guarantees of performance or availability.

Accounts and access

The App does not require a user account by default. If we offer optional accounts or licensed access, you are responsible for maintaining the confidentiality of your credentials and for activity under your account.

Fees and billing

If the App is offered as a paid product, any fees, taxes, and billing terms will be disclosed at the time of purchase and may be processed through the Apple App Store or other authorized channels.

Data integrity and outputs

You are responsible for verifying the accuracy and fitness of outputs, measurements, and reports. The App provides tools for analysis and documentation, but it does not guarantee scientific correctness or suitability for any particular purpose.

Restrictions

• Do not copy, reproduce, distribute, publicly display, or exploit the App or its content without written permission.
• Do not reverse engineer, decompile, disassemble, or attempt to derive source code, algorithms, models, or pipeline logic.
• Do not extract, scrape, or attempt to access underlying parameters, datasets, or simulation assets.
• Do not use the App or outputs to build, benchmark, or train machine learning or AI models without written authorization.
• Do not probe, benchmark, or analyze the Microscopic World Model or segmentation engine to replicate its behavior.
• Do not use the App to develop or assist a competing product or service.
• Do not remove or alter proprietary notices, watermarks, or attribution.
• Do not circumvent security, access controls, licensing limits, or usage restrictions.
• Do not publish performance benchmarks or comparative analyses without prior written consent.
• Do not rent, lease, sublicense, or resell access to the App.

Intellectual property and proprietary rights

The App, including its software, pipeline engine, Neural Engine optimizations, world model simulation, UI, design systems, visual assets, and documentation, is owned by Dr Matcha Studio or its licensors and is protected by intellectual property laws. All rights are reserved. No rights are granted except as expressly stated in these Terms of Use.

Microscopic World Model

The Microscopic World Model, leaf epidermal segmentation system, and related simulation assets are proprietary technology and trade secrets. You may not attempt to discover, copy, or disclose their design, parameters, or behavior, including through systematic testing or output collection.

Protection of proprietary information

You acknowledge that unauthorized use or disclosure of the App or its underlying technology would cause irreparable harm. We may seek injunctive or equitable relief in addition to any other remedies.

Patents and trademarks

StomaVision, LumaNorm Studio, Dr Matcha Studio, and related logos are trademarks or service marks of Dr Matcha Studio. We are in the process of seeking trademark and patent protection for aspects of the App. The absence of a filing does not waive any rights.

Your data and outputs

You retain ownership of your original images and the outputs you create with the App. We do not claim ownership of your content. The App and its underlying algorithms remain Dr Matcha Studio intellectual property.

Confidentiality

If you receive access to pre-release features, datasets, or documentation, you agree to treat them as confidential and not disclose them to third parties without written permission.

Feedback and submissions

If you submit ideas, feedback, or suggestions, you grant Dr Matcha Studio a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and commercialize them without restriction or obligation.

Third-party services and platform terms

Your use of the App may also be subject to Apple App Store terms and any third-party software or data providers you use. If those terms conflict with these Terms of Use, the third-party terms may govern their services.

Export controls

You may not use, export, or re-export the App in violation of applicable export control or sanctions laws.

Updates and availability

We may modify, suspend, or discontinue any part of the App at any time. We do not guarantee that the App will be available, secure, or error-free.

Disclaimers

The App is provided "as is" and "as available." We disclaim all warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Your use of the App is at your sole risk.

Limitation of liability

To the maximum extent permitted by law, Dr Matcha Studio will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from or related to your use of the App. In no event will our aggregate liability exceed $100 or the amount you paid to access the App, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Dr Matcha Studio and its affiliates, officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your use of the App or violation of these Terms of Use.

Termination

We may terminate or suspend your access to the App if you violate these Terms of Use. You may stop using the App at any time by uninstalling it.

Survival

Sections related to intellectual property, restrictions, disclaimers, limitation of liability, indemnification, and governing law will survive termination.

Governing law and venue

These Terms of Use are governed by the laws of the jurisdiction in which Dr Matcha Studio Limited is incorporated, without regard to conflict of laws principles. You agree to the exclusive jurisdiction and venue of courts located in that jurisdiction.

Assignment and severability

You may not assign these Terms of Use without our prior written consent. We may assign these Terms of Use in connection with a merger, acquisition, or sale of assets. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.

Entire agreement

These Terms of Use constitute the entire agreement between you and Dr Matcha Studio regarding the App and supersede any prior agreements or understandings.

Changes to these terms

We may update these Terms of Use at any time by posting a revised version. Your continued use of the App after changes become effective constitutes acceptance of the updated terms.
